TOOL HIRE STATION – HIRE TERMS & CONDITIONS (DRAFT)

These terms and conditions set out the basis on which we hire tools and equipment to you.
By placing an order on our website and ticking the box to confirm that you agree to these terms, you enter into a binding hire agreement with us.
1. About Us

References in these terms to “we”, “us”, “our” mean Tool Hire Station.
References to “you” and “your” mean the person or business hiring equipment from us.
2. Definitions

Equipment – any item of plant, machinery, tool or accessory you hire from us (for example cement mixers, wacker plates, pressure washers, generators, carpet cleaners, drywall sanders, etc.).

Hire Period – the period from the agreed delivery or collection time until the time the Equipment is returned to or collected by us, as confirmed in your booking.

Delivery Location – the address you ask us to deliver the Equipment to.
-
Deposit – any refundable amount we may take or pre-authorise as security against loss or damage.
-
Consumer – an individual acting wholly or mainly outside their trade, business or profession.
These terms apply when you hire Equipment from us as a Consumer. Different terms may apply if you are hiring as a business.
3. Forming the Contract
3.1. Our website, pricing and tool descriptions are an invitation to treat, not a binding offer.
3.2. When you place an order on our website and complete payment, you make an offer to hire the Equipment for the dates selected under these terms.
3.3. The contract is formed only when we send you a booking confirmation email. We may refuse an order (for example if the Equipment is unavailable, you are outside our service area, or we reasonably believe the hire is not appropriate or safe).
3.4. By placing an order you confirm that:
-
you are at least 18 years old;
-
you are legally capable of entering into a contract; and
-
you will use the Equipment only in accordance with these terms and any instructions we give you.
4. Prices, Payment and Deposits
4.1. Hire charges for each item and each hire period are shown on our website. Prices are in GBP and include/exclude VAT as indicated.
4.2. You must pay the hire charge for the full Hire Period in advance at checkout, together with any delivery/collection charges and any required Deposit.
4.3. We may take the Deposit either as:
-
a pre-authorisation on your card; or
-
a separate payment that is refundable after the Equipment is returned and checked.
4.4. The Deposit is security against loss, theft, late return, cleaning costs beyond normal use, and damage other than fair wear and tear.
4.5. If there are additional charges at the end of the hire (for example extended hire, damage or missing accessories), we may deduct these from the Deposit or charge your payment method, and will issue a breakdown of any amounts retained.
4.6. Our charges and Deposit levels may change from time to time, but changes will not affect confirmed bookings.
5. Delivery, Collection and Access
5.1. We normally deliver 1 day before your hire period starts, within an agreed time window. This is for your convenience and does not change the Hire Period.
5.2. Delivery is available only within our defined service area (currently Surrey and nearby areas, as shown on the website). If you book from outside our area, we may cancel the booking and refund you.
5.3. You are responsible for:
-
providing safe and reasonable access for delivery and collection;
-
ensuring someone 18+ is present to accept the Equipment; and
-
telling us about parking restrictions, access issues, or stairs/obstacles that may affect delivery.
5.4. If we attend the Delivery Location and are unable to deliver or collect because of access or no one being present, we may charge a failed delivery/collection fee.
5.5. Unless we have agreed otherwise, Equipment must remain at the Delivery Location and must not be moved to another address without our written consent.
6. Your Responsibilities During the Hire
6.1. You are responsible for the Equipment and for any damage, loss, theft or misuse from the time it is delivered or collected until it is returned to or collected by us.
6.2. You must:
-
use the Equipment only for its intended purpose and within its rated capacity;
-
follow all written and verbal instructions we provide;
-
use appropriate personal protective equipment (PPE) (for example safety boots, gloves, eye/ear protection, dust masks) where required;
-
keep the Equipment secure and protected from theft, vandalism and the weather;
-
keep children, pets and unauthorised persons away from the Equipment;
-
immediately stop using the Equipment and contact us if any fault, damage or unusual noise/vibration occurs.
6.3. You must not:
-
alter, modify or attempt to repair the Equipment;
-
remove or bypass any safety guards or devices;
-
use the Equipment when under the influence of alcohol, drugs or medication that may impair your ability;
-
use the Equipment for any illegal or unsafe purpose; or
-
allow anyone who is not competent to use it.
6.4. You are responsible for any consumables (fuel, oil, water, sanding discs, etc.) unless we have agreed to supply them.
6.5. You must comply with all relevant health and safety laws and guidance when using the Equipment. Those who hire out equipment are treated as suppliers under UK health & safety law, and we must ensure the Equipment is safe at the point of hire and provide safety information. You must follow that information to prevent accidents. HSE+1
7. Condition of the Equipment
7.1. We will inspect, test and maintain the Equipment so far as reasonably practicable to ensure it is safe and in working order before each hire. HSE+1
7.2. On delivery or collection you must check the Equipment and tell us immediately if anything appears missing, damaged or unsafe. If you do not, we will assume it was delivered in good condition.
7.3. If the Equipment develops a fault during the Hire Period:
-
stop using it straight away;
-
turn it off and disconnect from power/fuel where safe to do so;
-
contact us as soon as possible.
7.4. We will, at our discretion, either:
-
repair the Equipment;
-
replace it with similar Equipment; or
-
end the hire for that item and refund the unused portion of the hire charge.
7.5. We are not responsible for any consequential loss (e.g. loss of profit, wasted labour) resulting from Equipment failure, except where we have failed to exercise reasonable care and skill.
8. Hire Period, Extensions and Late Return
8.1. The Hire Period is as stated in your booking confirmation.
8.2. If you wish to extend the Hire Period:
-
contact us as early as possible;
-
extensions are subject to availability;
-
additional hire charges must be paid before the extension is confirmed.
8.3. If the Equipment is not ready for collection or not returned at the agreed time:
-
additional hire charges may apply at our standard daily rate;
-
we may charge a missed collection fee if we attend and cannot collect.
8.4. Continued failure to return the Equipment may be treated as loss or theft, and we may take steps to recover it and/or its replacement cost.
9. Loss, Theft and Damage
9.1. You are responsible for the Equipment from delivery/collection until it is back in our possession.
9.2. If the Equipment is lost, stolen or damaged beyond fair wear and tear during the Hire Period, you may be liable for:
-
the cost of repair; or
-
the full replacement cost (taking age and condition into account); and
-
any reasonable associated costs (for example recovery costs, admin fees).
9.3. You must notify us immediately if the Equipment is lost or stolen, and also notify the police and obtain a crime reference number if requested.
9.4. We recommend that you consider arranging insurance to cover your liability for loss or damage to hired equipment, particularly for high-value items.
10. Cancellation and Refunds
10.1. If you need to cancel a booking, please contact us as soon as possible.
10.2. Our standard cancellation policy is:
-
More than [48 hours] before delivery/collection – full refund of hire charges (less any non-refundable processing fee if stated on the website).
-
Within [48 hours] of delivery/collection – we may retain up to [50%] of the hire charges to cover allocation of the Equipment and scheduling.
-
On the day of delivery/collection or after the Hire Period has started – we may retain up to 100% of the hire charges.
10.3. If we have to cancel your booking (for example because the Equipment is unavailable or we cannot safely deliver), we will refund the hire charges and any Deposit you have paid. We will not be liable for any additional costs or losses you incur, except where required by law.
10.4. Nothing in this clause affects any statutory cancellation rights you may have under UK consumer law for online contracts. If such rights apply, we will honour them in addition to our own policy. Business Companion+1
11. Our Liability to You
11.1. We do not exclude or limit our liability for:
-
death or personal injury caused by our negligence;
-
fraud or fraudulent misrepresentation; or
-
any other liability that cannot be limited under UK law.
11.2. If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our negligence, but we are not responsible for:
-
loss of profit, income or business;
-
loss of opportunity;
-
any indirect or consequential loss.
11.3. Subject to clause 11.1, our total liability to you for any single hire contract is limited to the total hire charges you have paid for that contract.
11.4. We are not responsible for delays or failure to perform our obligations caused by events outside our reasonable control (for example severe weather, accidents, traffic incidents, strikes, or breakdowns). If this happens we will contact you as soon as reasonably possible to agree a solution (rescheduling, refund, etc.).
12. Your Personal Data
12.1. We will process your personal data in accordance with our Privacy Policy, which is available on our website.
12.2. We use your data to:
-
process bookings and payments;
-
arrange delivery and collection;
-
manage deposits, refunds and any claims;
-
comply with our legal obligations.

14. Governing Law and Jurisdiction
14.1. These terms are governed by the laws of England and Wales.
14.2. If you are a Consumer, you may bring legal proceedings in the courts of England and Wales, or in your local UK jurisdiction if different.
15. Changes to These Terms
15.1. We may update these terms from time to time. The version that applies to your contract is the one shown on our website at the time you place your order.
